Day after site visit, Naroda Patia judge rejects 2 pleas

Jyotsna Yagnik, the designated judge for the 2002 Naroda Patia massacre case, on Tuesday, rejected two different applications moved by the victims and the accused in the case.

The victims of Naroda Patia had moved a plea to implicate four policemen, including the then police inspectors of the Naroda, in the case and demanded their arrest. Partly rejecting the plea, the judge observed that she will take a decision while delivering the judgment in the case.

Giving details about the order, victims’ lawyer Yousuf Sheikh said, “The court has decided to evaluate our plea while delivering the final judgment. Therefore, we still hope that we will get justice.”

The four cops are the then  Naroda police inspectors  KK Mysorewala and VS Gohil, State Reserve Police Force (SRPF) sub-inspector Ketan Parikh and a constable.

Sheikh said, “Clear and explicit material exists to implicate the cops and arraign them as accused in the case as the victims have narrated their role in helping the accused in the case.”

Meanwhile, the court also rejected a plea moved by accused objecting the decision of Special Investigation Team (SIT) to not testify more witnesses in the case.

While delivering the judgment, the court said: “No essential or important witnesses have been dropped by the SIT while seeking the testimonies of 327 witnesses in the case. The plea can delay the trial more.”

The accused submitted before the court that there are many important witnesses who are yet to testify and the court should not allow the SIT to close the procedure of deposition of the witnesses. 

The Supreme Court-appointed SIT has showed 650 witnesses in the charge sheet and out of them, 327 witnesses have already been examined by both the defence counsels and public prosecutors.
