Akshardham case: Gujarat high court likely to give order tomorrow

The Gujarat high court is likely to pronounce order tomorrow in the Akshardham terror attack case of 2002 in which a lower court has sentenced three to death.

On July 1, 2006, special POTA court judge Sonia Gokani had awarded Adam Ajmeri, Shan Miya alias Chand Khan from Bareilly and Mufti Abdul Qayyum Mansuri death sentence.

While a local youth from Dariapur in the city, Mohammed Salim Shaikh was sentenced to life imprisonment, one Abdulmiyan Qadri was given a 10-year term and Altaf Hussain was sentenced to a five-year imprisonment.

A division bench of Justices R M Doshit and K M Thakar is likely to give judgement on the appeals of six convicts against the special POTA court's verdict.

Following the judgement by POTA court, the government had also moved the High Court for confirmation of death sentence.

Hearing in both the matters continued simultaneously and concluded in April 2008. Since then the order in the matter has been kept reserved.

The attack on Akshardham temple in Gandhinagar on September 24, 2002 by two militants, using automatic weapons hand grenades, had claimed 32 lives which included 28 visitors to the temple, two commandos, one NSG commando and one constable of the State Reserve Police (SRP).

The two militants were identified as Murtuza Hafiz Yasin and Ashraf Ali Mohammed Farooq had links with Pakistan based Lashkar-e-Taiba.

The Akshardham case was first in which accused were convicted under POTA in the country.

According to special public prosecutor in the case JM Panchal, 28 accused in the case are still absconding and most of them were in Pakistan or Gulf countries.

All accused are alleged to be having link with banned terrorist organisation like Jaish-e-Mohammad and Lashkar-e-Taiba. Some are also alleged to be linked to Pakistan intelligence agency ISI.

In all six people were convicted in the case and all of them have been convicted by the special POTA court in 2006, he said.

One of the accused in the case Shaukatullah Ghauri, was arrested from Hyderabad last year. Trail against Ghauri is pending, Panchal said.
