Aarushi’s parents seek fair probe, but CBI stays firm on closure

In a new twist to the Aarushi Talwar murder case, CBI on Tuesday insisted on closing the case while others, including her parents, are demanding a fair probe and a trial to take the case to a logical end.

Last week, CBI submitted its closure report in the special CBI court of Ghaziabad, seeking to close the investigations in the Aarushi-Hemraj murder case in citing insufficient evidence.

The move has sparked angry reactions from Aarushi’s parents and many others. Now, while activists demand a special investigating team (SIT), senior lawyers feels it is an open and shut case.

“A Special Task Force or SIT comprising India’s best forensic experts should be formed to look into Aarushi case as the case has become complicated. CBI had promised to nab the culprit and solve this case. All eyes are on this case. If CBI fails to solve it now, it will be a blot on its reputation,” prominent women’s rights activist Ranjana Kumari told DNA.

“People who destroyed evidence or ordered it should be caught. Destroying evidence is like participating in crime itself. No matter who they are, they should not be spared,” she said.

Senior criminal lawyer KTS Tulsi disagreed with the need for an SIT probe.

“Call for an SIT in Aarushi case is nothing but a tactic for delaying the trial. It is an open and shut case,” Tulsi said.

“Of four people in the house [Aarushi, Rajesh Talwar, Nupur Talwar and Hemraj], two were killed [Aarushi and Hemraj]. There is no evidence that indicates a forced entry into the house. The murder of those two were committed on the same floor and probably with the same weapon. How can a dead body [of Hemraj] walk to the terrace? The two people [Rajesh and Nupur Talwar] who were left in the house are answerable in this case. Court should take action on the evidence available,” Tulsi said.

Another senior criminal advocate Ramesh Gupta said SIT probe is not possible by this (lower) court.

“Only a high court and a higher court can order a SIT probe,” Gupta added.

A special CBI court had questioned CBI on Monday over the hurry in filing the closure report and has now fixed January 7 as the next date of hearing.
