The Bill that seeks to make triple talaq a criminal offence will be taken up later as there was no consensus on it in the Upper House of Parliament whose Monsoon Session ended on Friday.
The government can take it up in Winter Session (November-December). It also has the option of moving an Ordinance, or an executive order, to bring the proposed law in force till Parliament passes it.
The Bill was passed by the Lok Sabha in January, but will have to be passed again there in view of recent changes made, once it is approved by the Rajya Sabha.
"Triple Talaq Bill will not be taken up today because no consensus could be built around it," Rajya Sabha Chairperson Venkaiah Naidu said on Friday.
Congress has protested penal provisions for the customary practice that was legal till August last year when the Supreme Court ruled it as unconstitutional. The Union Cabinet has now introduced a bail provision.
The session proved to be much productive than expected this time. Apparently, aware of growing public perception against them as parliamentarians, the Opposition members not only took part in Question Hour and Zero Hour, they also allowed the government to take up important legislative business.
Rajya Sabha Chairperson M Venkaiah Naidu also played a key role in pushing legislative business as he thwarted the Opposition's attempt to stall proceedings on many occasions.
This allowed the passage of many important Bills like the SC/ST (Prevention of Atrocities (amendment) Bill, the National Sports University Bill and the Constitution 123rd Amendment Bill to give constitutional status to the National Commission for Backward Classes (NCBC).
The government, however, failed to pass the Muslim Women (Protection of Rights on Marriage) Bill, 2017 (called the Triple Talaq Bill) as it was deferred in the Rajya Sabha on the last day of the session.
