Sunanda Pushkar Death: Swamy asks cops to submit vigilance report highlighting shortcomings

Delayed seizures from the crime scene, no CCTV footage and deleted data from mobile phones finds mention in a report prepared by the Delhi Police highlighting the shortcomings in the Sunanda Puskar death case. This was flagged by Subramanian Swamy in a city court on Tuesday as Congress MP Shashi Tharoor was summoned and asked to be present in court on July 7.

Responding to the court order Tharoor wrote on that he had always co-operated with the investigating team.

“I would like to reiterate my position that I find the charges preposterous and baseless, the product of a malicious and vindictive campaign against myself. I will continue to rigoursly contest the charges and maintain my steadfast conviction that ultimately the truth will prevail through the judicial system that we are privileged to have in our country,” said Tharoor in the statement. 

A vigilance enquiry was ordered after the then DCP Ishwar Singh in a report to then Commissioner of Delhi Police, Alok Kumar had mentioned regarding the shortcomings in the case. As per Singh there were five major shortcomings.

“No medicines were seized on January 18, 2014 from the place of occurrence. Alprax and other medicines were seized on January 19, 2014. Mobile phones and laptop of Pushkar were taken to Dubai by Shiv Menon (Pushkar’s son) when he had arrived for last rites. The same were seized on January 25, 2014 (laptop) and three blackberry mobile phones on January 30, 2014. However, some of the data was found deleted when it was seized,” stated the report.

The report further stated that the bed sheet, bed cover and some eatables were seized from the room only on November 5, 2014, months after her death. In fact, even the entire CCTV footage were not available especially of the time when she was found dead.      

BJP leader Subramanian Swamy who has been vocal with regard to the case had moved an application to allow him to assist the prosecution in the case. Swamy also added during the probe major evidences were tampered with. The Delhi Police has been asked to reply to Swamy’s plea. Swamy is now pressing for this to be a part of record. The court has asked the Delhi police to file a reply in this regard on Swamy’s petition. 

ACMM Samar Vishal said, “On the basis of the police report I take cognizance of offence of abetment to suicide punishable under section 306 of Indian Penal Code (IPC) and of committing cruelty upon her punishable under section 498-A of IPC by Dr Shashi Thraoor.” The court has asked Tharoor to appear before it on July 7 at 10am.
