Judge BH Loya's son has clarified that the family doesn't believe that there is any suspicion regarding death of the  special CBI court judge 4 years ago.

Judge Loya's son Anuj said in a press conference that they are greatly distressed by the developments of last few days. Anuj flanked with his lawyer categorically denied that there was any malpractice in Justice Loya's death who was hearing the sensitive Sohrabuddin Sheikh encounter case when he died of a heart attack in 2014.

Anuj said on Sunday: Our family is pained with the chain of events in past few days. Please don't harass us.  Anuj Loya urged NGOs and politicians to stop "harassing" his family over his father's death. His lawyer was more forthcoming, categorically denying any controversy regarding the death of the late judge.

The lawyer said:

There is no controversy. No need of politicising the issue. This is a tragic event. We do not want to be victims of politicisation of the issue. Let it remain the way it is, non - controversial: Ameet Naik, Lawyer #JusticeLoya pic.twitter.com/p4lKH5XoYi

When asked about the later, Anuj had written in the past or the interview given by his family members where they expressed doubt about Loya's death, late judge's son said that they were under mental distress at that point of time. Anuj also pointed out that he was only 17 at that point of time. But now after time has passed, they have come to the opinion that there is no doubt regarding his father's death, said Anuj Loya.

The Bombay Lawyers Association (BLA) on Saturday claimed a petition filed in the Supreme Court, seeking a probe into the death of special CBI judge B H Loya, was "motivated".

The petition, filed by journalist B R Lone, was submitted to ensure a petition by the association on the same issue is not heard by the Bombay High Court, the BLA claimed. The association had earlier this week petitioned the HC, seeking a judicial inquiry into the circumstances surrounding the death of Loya in 2014.

Loya, at the time, was hearing the case related to the alleged fake encounter killing of gangster Sohrabuddin Sheikh, his wife Kausar Bi and associate Tulsi Prajapati in 2005.

Loya had died of cardiac arrest in Nagpur on December 1, 2014, when he had gone to attend the wedding of a colleague's daughter.

The Supreme Court will not be hearing the Public Interest Litigation (PIL) seeking a probe into the alleged mysterious death of Central Bureau of Investigation (CBI) judge B H Loya on Monday.

The latest move unfolds as one of the apex court judges Justice Mohan M Shantanagoudar is on leave.

On Friday, the top court asked the Maharashtra government to submit the postmortem report of the CBI judge, asserting that the "matter was very serious".

The apex court had earlier fixed the date of hearing on January 15.

Earlier on Thursday, a bench comprising Chief Justice Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud, "sought an urgent hearing on the plea" for a probe into Judge Loya's death on December 1, 2014.
