No respite for Ahmedabad's Bhavnirzar, govt to reclaim 15 acre

The Bhavnirzar religious complex run by the Swadhyay Parivar at a prime location in Satellite was refused any relief by the state government on Thursday. The government, by filing a reply before Gujarat high court, stated that it had already identified 15 acre of land for repossession from the two trusts run by the Parivar.

The government filed the affidavit before the high court which is hearing a petition filed by Tatwajana Vidyapith, a trust of the Parivar, challenging the government’s move to take possession of the land.

Three different stretches of land were allotted to the Parivar in 1971 and 1975 on lease for agricultural and educational purpose and also for the purpose of providing hostel facility to students. The government has now refused to extend the lease on the grounds that there has been a ‘change of use’.

It mentioned that the trust is not using the land either for agriculture or for educational purpose. DD Kapadia, in-charge prant officer of Vejalpur, said in the affidavit that the petition of the trust should be rejected as the District Inspector of Land Record (DILR) had already completed the procedure to earmark a portion of the 15-acre land.

The affidavit said that on June 1, 2011 the trust was informed that 15 acre of land given to it will be reclaimed by the government on June 7. “It also demanded payment of rent for the property as the lease period had ended on November 18, 2001.    

The government had refused to grant extension of the lease by another 99 years as urged by the trust," the affidavit said. The affidavit further said that the move to repossess the land was done after giving the trust ample opportunity.

Earlier, the counsel for the trust, Harshad Prajapti, stated in a petition that the court had adjourned the case till July 7 as the government sought time to file a reply. 

"We have mentioned in the petition that, the government cannot claim possession of the land as the trust has its ownership after the government finalised town planning scheme in 2000."

According to case details, the government had allotted two plots — one 15 acre and the other 7 acre —  to the Parivar in 1971 on a lease for 15 years. The government then again allotted the plot to the trust in 1975 for 30 years.

Meanwhile, the government launched a town planning scheme in the area and approved the final scheme by cutting a stretch of the land of the trust. The trust claimed that, after the final TP scheme, it has ownership of the land.
