A division bench of Justice VM Kanade and Justice AS Gadkari held the government resolution issued on October 28, 2016, to be in the interest of the public at large and thus rejected a bunch of petitions, including one filed by Palghar toddy seller Sandesh Narvekar.
The bench accepted the arguments made by Government Pleader Abinandan Vagyani that the government had powers to regulate business regarding liquor and liquor commodity and that it was not in violation of Article 19 (1) (G) of the Constitution of India, as claimed by the petitioners.
Further, Vagyani argued that on inspection by the authorities it was found that if around 500 toddy trees were tapped, the supply was more than the estimated supply. This indicated that there was adulteration and such a scenario was harmful to the health of the society at large.
The petitioners argued that they had been in the business of supplying toddy since 1975-76 against the government's claim of imposing restrictions like allotting license to permanent residents of a village. They also said that the government's order of allotting license to only one shop in an area having 1,000 trees was faulty, illegal and would affect their business.
The court though rejected the claim by the petitioners and accepted the arguments of the government and dismissed the petitions.
