Nida Khan remains defiant aftre fatwa ousts her from Islam, says it's illegal

Unfazed by her expulsion from Islam for taking up cases of triple talaq and Halala victims, Nida Khan on Tuesday said that her fight against the social evils in Muslim community and indiscrimination against women will continue.

Darul Ifta, the fatwa factory of Darul Uloom Deoband, had issued a fatwa against her on Sunday, ostracising her from Islam and directing community members to not to keep any touch with her. She will also have to live her life like an outcast till she offers remorse to "sins she has committed" by disobeying and defying Islamic laws, said the fatwa.

The fatwa said that she will not be given a place in the Muslim graveyard and anyone from the community found helping her will also meet the same fate. Nida Khan was married in one of the most revered family of Aala Hazrat Dargah family on February 18, 2015.

Reacting to the fatwa against her, Khan said that those who were trying to gag voices of Muslim women on triple talaq and nikah halala should take shelter in Pakistan which is governed by Islamic laws and allows these social evils. "Who are these ulemas to issue fatwa against me? India is a democratic country and we will continue our fight against triple talaq and halala," challenged Khan.

Khan also demanded action against Ulemas who issue fatwa against women without having any legal rights. "Action should be initiated against such Ulemas who are making a mockery of the Indian Constitution to exploit Muslim women to deny them equal rights," demanded Khan.

Khan also asserted that the Supreme Court had banned fatwa in 2005. "No Ulema has any right to oust any Muslim from Islam. They are misinterpreting Sharia and Islamic laws to deny basic rights to Musim women," she charged.
Incidentally, a fatwa was also issued against Farhat Naqvi, sister of Union Minister Mukhtar Abbas Naqvi and Founder of Mera Haq NGO. However, it was later withdrawn as Naqvi belongs to the Shiite Muslim community and the fatwa would not have been applicable on her.
