The Yogi Adityanath government has decided to cite cases of fatwa against Triple Talaq crusader Nidha Khan and Shahbina's Nikah Halala before Prime Minister Narendra Modi for raking them up in the Parliament during debate on the contentious issues.

Khan won a major battle on Wednesday when a Bareilly Court rejected her husband Sheeraz Raza Khan's plea to withdraw the case and ordered a trial against him, his parents and brother in a domestic violence case. On Tuesday, Khan had won another battle of getting rape case registered against Shahbina's husband, father-in-law and brothers in a Nikah Halala case.

"Registration of rape case against the accused was a major victory in our fight against Nikah Halala," said Shameena Begum, a social worker, who has filed a petition in the SC against Nikah Halala

In his order, ACJM-First Siyaram Chaurasia said that the law does not differentiate women on the basis of their religion or caste. "Even if the Talaq is formalised, the domestic violence case would continue against all accused," the Judge said.

Her husband Sheeraz Raza Khan, father-in-law Usman Raza Khan alia Anjum Mia, mother-in-law Shimmi and brother-in-law Irfaan Raza Khan will now be tried in domestic violence case lodged by Nida Khan.

State Minority Minister Dharampal Singh said that it was unfortunate that fatwa was issued against a Muslim woman who is fighting for the Triple Talaq and Nikah Halala victims. He claimed that the state was seeking legal opinion to initiate action against those who issued fatwa against Nidha Khan.

"We have rejected the Nikah Halala as she was sexually assaulted against her will and registered a rape case against her husband, father-in-law and brothers," said Muniraj G, the SSP Bareilly. Singh claimed that the state has prepared a list of Triple Talaq victims and Nikah-Halala cases which would be sent to Union Law Minister Ravi Shankar Prasad for action.
