Any Indian can now buy land in J&K, but not in Ladakh; here's why

On Tuesday, the government notified new laws that allow any Indian to buy land in the union territory of Jammu and Kashmir.

In a major development on Tuesday, the Centre notified the new Land Laws for Jammu & Kashmir, paving the way for any Indian to buy land in the union territory.

The union home ministry has notified this on Monday in a gazette notification. The MHA notified what it calls UT of Jammu and Kashmir Reorganisation (Adaptation of Central Laws) Third Order, 2020. The order comes into force with immediate effect.

However, the same was not applied to Ladakh.

The reason for this is the negotiations that were held last month between the government and the leaders from Ladakh who pressed for the demand for Article 371 or Sixth Schedule after passing the resolution amid the India-China clash at the Line of Actual Control (LAC).

Notably, Article 371 has 'special provisions' for a total of 11 states, including six northeastern states so that their unique cultural identity and economic interest can be protected. Ladakhi leaders have stressed that 90 per cent of their population is 'tribal', and therefore, their rights need to be protected.

Similar provisions are present in different states like Himachal Pradesh and Uttarakhand, restricting Indians from other states from buying land there.

Pressing their demand, the leaders from Ladakh, including those of BJP, teamed up to preserve the unique status of the union territory and also threatened to boycott the recently held Ladakh Autonomous Hill Development Council (LAHDC) elections.

The boycott was called off only after the leaders were convinced by the BJP leaders in New Delhi after a meeting with senior leaders including Union ministers Kiren Rijiju and G Kishan Reddy.

It may also be noted that the BJP won the Ladakh hill development council elections and secured 15 out of 26 seats, while Congress won only nine.
