With Mumbai Police struggling to investigate the alleged sexual harassment incidents against former The Viral Fever (TVF) employees by the CEO, advocate Rizwan Siddiquee has urged the police to file a case of molestation and later find the women as witnesses.
A 43-year-old advocate from Mumbai has urged the Mumbai police to file a third party First Information Report against the The Viral Fever (TVF) Chief Executive Officer (CEO) Arunabh Kumar. A recent blogpost, which went viral, alleged sexual harassment at the workplace by Kumar. Later, nine other women came forward with similar allegations on social media.
Advocate Rizwan Siddiquee approached the Mumbai Police with an application to file a formal complaint against Arunabh Kumar. The complaint stated various cases in which third party FIR had been registered.
"Anyone can set the criminal law into motion unless the criminal act falls under the provisions of sections 195 to 199 of the Criminal Procedure Code and this instance is not included in these provisions and so the police have to file a formal complaint," said Siddiquee.
Siddiquee demanded that the complaint be filed under sections 354 (assault or criminal force to woman with intent to outrage her modesty), 354(A) (sexual harassment), 354(D) (stalking) and 509 (word, gesture or act intended to insult the modesty of a woman) of the Indian Penal Code.
"The police is finding it difficult to file a complaint because the women who have been sexually exploited are not coming forward to file the complaint but if I am the complainant, the women can give their statements without fear and can be the witness in the case," said Siddiquee.
Shailesh Pasalwad, senior Inspector, MIDC police station said, "We have received the application and we will decide the further course of action."
