Anti-Sikh riots: Sajjan Kumar told to reply to plea seeking bail cancellation

The Delhi High Court (HC) on Wednesday issued a notice to Congress leader Sajjan Kumar, seeking his response to a plea demanding cancellation of the anticipatory bail granted to him by a trial court in the 1984 anti-Sikh riots case.

Justice I S Mehta issued the notice, fixing November 10 as the next date of hearing. Earlier, two judges had recused themselves from the case. The Congress leader was granted anticipatory bail on December 21, 2016, which was challenged by the Special Investigative Team (SIT) probing the case, in January this year.

The SIT had submitted that the cases filed against Kumar in Janakpuri and Vikaspuri police stations in west Delhi were lodged after a delay of over 30 years, as the complainant was"scared"to name the accused due to his"powerful"position.

The SIT counsel contended that since Kumar has been named in the investigation, he needed to be questioned and so his custody was necessary for evidence in the matter.

The complaint lodged in the Janakpuri station pertained to the killing of Sohan Singh and his son-in-law Avtar Singh on November 1, 1984. The other related to the killing of Gurcharan Singh on November 2, 1984.

According to the complainant, Kumar was seen leading a mob that killed these people. While seeking the anticipatory bail, the Congress leader, however, said that the FIR was filed after 32 years, and it showed that it was politically motivated.

The SIT had submitted that the delay in the registration of the FIR and not assigning the investigation to an independent agency clearly suggested the influence of the accused at the time.

Granting relief to the former MP on a personal bond of Rs one lakh and a surety of the like amount, the trial court had asked him not to leave the country without permission and to cooperate in the probe.
