If you are looking at setting up a commercial establishment in a residential area, you could be in trouble—especially in Malleswaram, Vasanthnagar, Jayanagar, Vijayanagar, VV Puram, Rajajinagar, RT Nagar, and Richmond Town. The high court on Wednesday directed that in these areas no further permission shall be granted for reconstruction or redevelopment, except for residential use.
A division bench directed that no further reconstruction or redevelopment should be carried out in these areas, which are mentioned as ‘residential’ as per 1995 CDP for residential purposes. The direction came while the bench was hearing a petition filed by the Citizens’ Action Forum, questioning the legality of the Revised Master Plan (RMP)-2015 (earlier known as Comprehensive Development Plan-CDP).
The Citizens’ Action Forum filed an application against granting permission to use residential buildings for commercial purposes as per mixed residential area classification of the RMP-2015. The petition pleaded for immediately stopping the trend as the state government itself has “doubts on the credibility and implementation of RMP-2015”.
The application was filed during a hearing of the petition filed in 2008 questioning the legality of the RMP-2015. The forum contended that the BDA, in its response, had failed to address the grievances of the public before finalising the RMP-2015.
Vijay Menon, member of the Citizens’ Action Forum, Koramangala, said: “RMP-2015 allows rampant commercialisation of residential areas. We are not saying that there should not be commercial activity, but there should be one particular place identified where the activity should run; not beside a house. Further a residential area should have open spaces.”
