Schools want UP fee model, Gujarat govt says no

The state government has shot down most of the recommendations made by the Federation of Self-Financed scho-ols with regards to a scheme, as asked by the Surpeme court, to formulate by both the parties concerning the Gujarat Self-Financed Sch-ools (Regulation of Fees) Act.

The Supreme court, on April 24, had asked the state government and the school managements to prepare a joint scheme for activities and expenses incurred. The formula if possible should be acceptable to both, the bench said. Going by the order, the federation had sent a list of recommendations to the state government on May 21 which included implementation of UP ordinance of 2018, uniform policy of surplus, etc. However, the state government has shot down and expressed its concerns in most of the recommendations.

Till date, the state nor the schools have come to an amicable solution for a joint scheme. The state government on June 19 had written to the Archit Bhatt of Self-financed Schools Management Association stating that they have also come up with a formula and to discuss the same, a meeting will be held with the minister. The meeting, however, scheduled on June 26 has been postponed.

In a reply to the schools on their formula, the state government stated: "We are in receipt of communication dated May 21 and the federation recommends that the UP ordinance of 2018 for private schools be implemented in which the existing fees are accepted and the self-financed schools are given the autonomy to fix their fees for all new admissions without any regulatory oversee.

The ordinance stipulates an automatic 10% increase without any regulatory approval and it is only if the increase of fees goes beyond the stipulated formula would it have to go to the regulatory authorities for approval. Many states have come up with Acts including Gujarat and some of these Acts have been challenged in courts. In Gujarat, the Act was passed by the state legislature on March 30, 2017, by the ascent of the governor on April 12.

Approximately 75% of the schools have submitted their proposals in terms of the provisions of the Act.

TOUGH CHOICE

The state government had also convened a meeting with CM and the issue of surplus was deliberated. The question of determination of surplus is neither easy nor simple and the state believes that no uniform policy can be adopted.
