Minor's pregnancy termination risky, says Ahmedabad civil hospital medical board

Ahmedabad civil hospital medical board on Wednesday submitted a report to the Gujarat High Court, suggesting that the minor rape victim, who was 32 weeks pregnant, should deliver the baby. The board said that minor is just four to five weeks away from giving birth to a baby and even a medical intervention at this stage could harm the newborn.

The court single bench Justice JB Pardiwala had constituted a medical board on Tuesday to examine the rape victim and wanted to know if there was any risk involved with the victim's health. The court had asked the board to submit the report on Wednesday.

Dr Mahima Jain, (HoD Gynecologist Department), Dr Minakshi Parikh (HoD Psychiatric Department) who submitted the report, said that the foetus is about 31 to 32 weeks old and so, in all probability, it will have a life. Therefore, any experiment with the foetus could be risky for the baby.

The foetus on Wednesday weighed 1.8 kilos. The court suggested that the ideal situation is to ask the victim to deliver the baby and later the baby can be handed over to an orphanage. Public prosecutor Mitesh Amin submitted that the state government will take care of the victim's health till she gives birth to the baby.

Victim's advocate Kumar Trivedi told the court that it should set some guidelines for such cases so that victim doesn't have to suffer trauma and agony. He submitted that the pregnancy issue came to light only in December 2017, when the parents found her stomach swelling and she complained of the stomachache. The doctors found her 25 weeks pregnant when she was subject to medical examination. The court is yet to deliver its judgment.
