Gujarat High Court to decide on song copyright case today

A division bench of Gujarat high court is likely to pronounce its  judgment on a petition moved by popular Gujarati singer Kinjal Dave over a matter involving copyright infringement.

Dave had challenged an ex-parte order of the lower court in a case involving copyright issues of her song Char Bangdi Vadi Gadi . The lower court had restrained Dave from using the song in live shows, concerts, as well as for online downloads. She was to file her reply in the case by January 22 in the lower court.

On Wednesday, the division bench of the high court while hearing the petition questioned the singer as to why she did not file her reply with the lower court and why did she approached the court 20 days after the suit was filed.

The court also questioned the counsel of Red Ribbons Entertainment when they argued that the use of the song by Dave incurred them huge  losses. The court also questioned the counsel on why did it take the company so long to challenge, as the song was uploaded in December 2016 and had led to losses.

Earlier a commercial court in Ahmedabad had issued notice to Dave after Mumbai-based Red Ribbon Entertainment Private Limited filed a complaint in this connection. The firm had claimed that the song was an original piece of Melbourne-based Kathiawadi singer Kartik Patel.
