Gujarat High Court gives relief to Congress MLA Alpesh Thakor

The court has also directed the Banaskantha sessions court to decide on the plea of Thakor against the defamation proceedings within this period.

The Gujarat High Court has stayed the trial in defamation proceedings initiated against Congress MLA Alpesh Thakor by then superintendent of police Niraj Badgujar pending in a Deesa Court for three more weeks. The court has also directed the Banaskantha sessions court to decide on the plea of Thakor against the defamation proceedings within this period.

Notably, Thakor had earlier moved the sessions court against the defamation proceedings and sought a stay on the same until his plea is decided. While the plea remained pending, the sessions court refused to grant any stay on the proceedings, against which Thakor moved the high court.

Now, the high court has directed the sessions court to decide on Thakor's plea within three-weeks, while clarifying that the stay on the defamation proceedings will continue till the matter is decided by the sessions court. The single judge bench of Justice Sonia Gokani court has also ordered the Congress MLA and Badgujar to cooperate with the sessions court for faster disposal of Thakor's plea.

Notably, Badgujar had filed a criminal defamation proceeding against Thakor in Deesa for allegedly remarking that the IPS officer takes money from bootleggers while addressing locals in a village in Banaskantha district in February. After the defamation proceedings were filed by the cop, the lower court issued summons against him on April 5 directing him to remain present before the court on May 3.

The IPS officer had also submitted a video clip of Thakor's speech before the Deesa Court, which purportedly shows Thakor, who represents the Radhanpur seat in the adjoining Patan district, accusing the police officer of taking bribes from bootleggers.

Recently, the Congress MLA and the convener of Gujarat Kshatriya Thakor Sena was under fire for the attacks on migrants in Gujarat that resulted in their mass exodus after which the state administration had to swing in action to instil confidence in migrants and to ensure their safe return.
