Firing case: Complainant charges police with lying

In an interesting case, the state government submitted an application before the city sessions court on Wednesday requesting that summons be issued to a doctor practising in Chhattisgarh to depose in a firing case of 1998 after the complainant in the case contended that court duty constable had deliberately said that the doctor was not in the country.

According to case details, one Pradeep Babulal had allegedly shot at Jagdish Khalsa, a resident of Khadia after he refused to pay the extortion money demanded by Babulal after he purchased an old house in the area. On December 14, 1998, Khalsa lodged a complaint with police saying that he had been shot at by Babulal.

The complainant later submitted an application to the court saying that after he sustained injuries in the firing, a doctor Mao Ghosh had treated him. Khalsa also prayed that the court duty constable, who is responsible for producing witnesses in the case, submitted oral evidence that the doctor was not in the country and was abroad.

Khalsa said Ghosh was, in fact, practicing in Bhilai in Chhattisgarh and that the court duty constable had deliberately tried to hide this fact so that evidence with regard to the injuries sustained by the complainant could not be produced in the court.

Lawyers Mitesh Amin and Sanjay Thakker appeared for the complainant. After the public prosecutor went through the application, a plea was submitted by the state praying that summons be issued to the doctor so that evidence with regard to injuries sustained by Khalsa are produced before court. Additional sessions judge IB Waghela adjourned hearing in the matter till June 18.
