The special investigating team is all set to pay special attention to a complaint filed by Jakia Jafri in the Supreme Court. A special team may be appointed to conduct an investigation into the complaint.
In her complaint, Jafri blamed many police officials and BJP leaders, including Gujarat chief minister Narendra Modi, accusing them of perpetrating to kill her husband, Ahesan Jafri, and others at Gulbarg society in Asarwa in 2002.

The SIT will call Jafri to examine her complaint, which she filed against as many as 63 people, including political leaders, IPS officers and police officials. “We will examine the complaint of the petitioner and will later on decide whether to conduct an investigation,” an SIT member said, adding, “We may also form a special team to investigate the matter,” for which it may acquire more manpower.

If a team is formed to investigate Jafri’s complaint, it will be the first time such action has been taken in the case of a specific complaint. Till now, investigating teams have been ordered to investigate specific incidents.“The SIT is already investigating the Gulbarg massacre case. But the other team will investigate the points specifically mentioned by Jafri,” a source in the SIT said.

In November 2007, the Gujarat high court had rejected the petition filed by Jakia Jafri and Citizens for Justice and Peace (CJP), an NGO seeking directions so that a police complaint can be filed against chief minister Narendra Modi, members of his cabinet and police officials allegedly involved in the post-Godhra riots of 2002.

The high court had then asked the petitioners to submit a private complaint before the concerned magistrate in accordance with law. While rejecting the petition, Justice MR Shah also held that the court was not going into the merits of the case and that submission made by Jakia Jafri that the magistrate before whom the complaint was to be filed will not be in a position to enquire into the case, cannot be accepted.

On the prayer of Jafri that there should be a CBI enquiry in the matter, the court had observed that the statements/affidavits on the basis of which such statements have been made has no evidentiary value. “On considering the averments and allegations in the complaint dated 8.6.2006 which is sought to be investigated by the CBI, the entire complaint is by and large based upon some affidavits/statements of the third party,” the court had observed.
