SIT may challenge Maya bail

A day after minister for women development and child welfare Maya Kodnani and Jaydeep Patel were granted anticipatory bails, SIT is planning to approach the Gujarat high court.

A day after minister for women development and child welfare Maya Kodnani and Vishwa Hindu Parishad (VHP) leader Jaydeep Patel were granted anticipatory bails, the special investigation team (SIT) is planning to approach the Gujarat high court. Sources close to the development told DNA that the SIT may knock on the high court's door against the order.

Kodnani and Patel were granted anticipatory bails and allowed to file applications for regular bails within 10 days of their arrest by the SIT. However, sources said the SIT instead of arresting the duo, in all likelihood, would go to the high court. "Preparations in this direction are already on," sources added. In its order, the court observed that the order of anticipatory bail would stand for 90 days.

Confirming the development, SIT chairman RK Raghavan told DNA, "We may challenge the anticipatory bails granted to Kodnani and Patel, in the high court." Raghavan said the SIT was considering all legal measures that could be used at this stage of the investigation.
Raghavan was in the city on Friday to streamline the SIT investigation and also to prepare a status report of the investigations to be submitted to the supreme court. SIT is also preparing the final report which has to be submitted by February 15 to the apex court. "We are preparing a status report which will be submitted soon to SC which will be followed by the final report," Raghavan said.

While granting bail to the duo on Thursday, additional sessions judge AK Aswani observed that even though the offence was committed in 2002, the names of the accused were first mentioned in May 2008 and then in June 2008. The court also observed that other accused have been released on regular and anticipatory bails on appropriate grounds. The court observed that the duo had not tried to influence witnesses in the case and do not have a criminal history.

Special public prosecutor for SIT, Sudhir Brahmbhatt told DNA, "We have received a copy of the bail order. We will send our opinion to the legal department after going through the order."

SIT has also started recording statements of the police officials, who are alleged to be connected with the duo, in the Naroda Gaam and Naroda Patia cases.
