Police whisk Talwar away

NEW DELHI: After facing flak for their series of flip-flops in the investigation of the Aarushi Talwar and Hemraj murder case, the Noida police may now draw the wrath of the judiciary.

Abhijeet Chatterjee, lawyer of dentist Dr Rajesh Talwar, the prime accused in the double murder case, filed a contempt of court petition against the police on Wednesday for alleged “violation of a judicial order”.

Chief Judicial Magistrate AK Singh had on Tuesday granted three-day police remand for Talwar but ruled that his lawyers would accompany him during police interrogation. However, violating the order, the police whisked the dentist away to an undisclosed location without informing his family or lawyers.

“We waited for nearly four hours to present the court order to the police but they didn’t turn up. We later came to know that Rajesh had been taken away for interrogation but the police refused to disclose his whereabouts,” said Dr Dinesh Talwar, Rajesh’s brother.

“We are very scared for Rajesh, if the police can show so much disregard for the law then they could also force him into confessing to a crime that he has not even committed,” he said.

Repeated calls made by the Talwars and their lawyers to the investigating officers of the case went unanswered, creating panic.  

“We have made over 20 calls to the cops but they are just not answering. The officials at the Sector 20 police station too haven’t been helpful. The police have clearly violated judicial orders and should be prepared for contempt of court proceedings to be initiated against them,” said Chatterjee.

While the court may take up the issue of contempt on Friday, a senior police officer tried to play down the alleged violation.

“Rajesh had been largely evasive when he was questioned about the crime before the arrest. Now in the presence of his lawyers, it would have been even more difficult to extract information from him. The cops will reply to the contempt issue when it is taken up,” said the official, who did not wish to be named.

Expressing lack of faith in the Noida police, Dr Dinesh Talwar once again demanded an impartial CBI probe into the case to help prevent his “innocent brother from being made a scapegoat”.
