Court to record Nandigram accused's 'confession' on Thursday

NEW DELHI: In a major boost to the CBI which is investigating the Nandigram violence, a court here has agreed to record the "confessional" statement of an accused, Badal Garu Das, on Thursday.
     
The CBI has filed an application in the court of Metropolitan Magistrate Chandra Shekhar claiming that Das wanted to record his statement under Section 164 of the Criminal Procedure Code.
     
Allowing the plea, the court decided to record the statement tomorrow and asked the CBI to bring an official interpreter for helping it as Das could understand Bangla language only.
     
Das, a resident of East Midnapur, was arrested on March 13 in the case registered by the CBI following a direction by the Calcutta High Court on November 16, last year.
     
"During interrogation, he has voluntarily expressed a desire to make a confessional statement before the Magistrate," the CBI said, in its application filed before the court on March 15.
     
The court, remanding Das to judicial custody till March 17, had cautioned him to think over the implications of his decision to confess as his statement may be used against him during the trial.
     
A practising lawyer from the Supreme Court, Robin Mazumdar, appeared on March 17 as an interpreter to explain to Das the consequences of making a "confessional" statement before the court.
    
The court, then again, sent Das to judicial custody till tomorrow to give him a chance to think over the issue making "confessional" statement.
    
A case invoking various provisions of the IPC including 120B (criminal conspiracy), 147 (rioting), 186 (deterring a public servant from discharge of his duties) was registered with Nandigram police station in East Midnapur district of West Bengal following a large-scale violence to protest against land acquisition.
