Speaker is not under our supervision, SC tells Goa Cong MLA

The SC has declined to pass any direction to the Goa Speaker on the plea of Cong MLA Agnel Fernandes who sought permission to withdraw his petition.

NEW DELHI: The Supreme Court has declined to pass any direction to the Goa Speaker on the plea of Congress MLA Agnel Fernandes who sought permission to withdraw his petition seeking disqualification of two Maharashtra Gomantak Party MLAs.
    
"The Speaker is not under our supervision. So why do you want us to give a direction. You make your application before the Speaker," a bench of Chief Justice K G Balakrishnan and R V Raveendran, curtly told the Congress MLA's counsel.
    
Agnel Fernandes had earlier filed the petition before Speaker Pratapsinh Rane seeking disqualification of MGP MLAs members Sudin Dhavalikar and Dipak Dhavilkar.
    
Acting upon Agnel's petition, the Speaker in his interim order on July 30, had barred the two MLAs, who then had sided with the BJP-led opposition, to vote on the confidence motion moved by the Chief Minister Digambar Kamat.
    
Challenging the Speaker's action, the two aggrieved MLAs filed a writ petition before the apex court, which on August 20, reserved its order on the issue.
    
But in the meantime, the Speaker passed another interim order confirming his earlier order of restraining the MLAs from voting which was again challenged by the legislators before the apex court as contempt since it had already reserved its verdict on the issue.

But in the meantime due to the changed political scenario in the state, the Congress MLA has sought the apex court's permission for withdrawing his petition filed before the Speaker which the apex court has declined.
    
However, the apex court posted to October 29, further hearing on the two MLA's petition challenging the Speaker's order restraining them from voting during the confidence vote.
    
The MGP MLAs had alleged that the action of the Speaker was illegal and unconstitutional and contrary to the principles of Parliamentary democracy.
