The Patna High Court on Monday adjourned till October 31 the hearing on Bihar government's appeal challenging the acquittal of Railway Minister Lalu Prasad and wife Rabri Devi in a Disproportionate Assets case, an off-shoot of the Fodder Scam.

Justice Ramesh Kumar Datta, who had on September 20 held the petition filed by the state government as maintainable and posted the matter for admission on Monday, adjourned the hearing on it as Chittranjan Sinha, appearing on behalf of Lalu-Rabri, sought a week's time to move the Supreme Court against the order.
"Since my clients have decided to go in appeal in the apex court against the HC's order holding the petition challenging their acquittal maintainable, I seek a week's time for the purpose," Sinha argued.
Sinha's plea was accepted by the court which deferred the hearing.
Lalu Prasad and Rabri Devi had contested the state government's appeal, saying it was not competent to do so as the DA case and all other Fodder Scam cases were investigated by CBI, a central government agency.
Special CBI judge Muni Lal Paswan had on December 18, 2006 acquitted the duo in the case charging Prasad with having amassed assets worth Rs 46 lakh beyond his known sources of income when he was chief minister between 1990 and 1997. Rabri Devi was made a co-accused in the case.
The state government had decided to appeal against the CBI court verdict after the central agency, which had probed the DA case, decided not to challenge the acquittal.
