SC to hear Memons' plea for interim bail on September 7

The interim bail plea of three relatives of Tiger Memon, sentenced to life in the 1993 Mumbai serial blasts, will be heard on September 7 by the Supreme Court.

NEW DELHI: The interim bail plea of three relatives of Tiger Memon, sentenced to life in the 1993 Mumbai serial blasts, will be heard on September 7 by a Supreme Court Bench headed by Chief Justice KG Balakrishnan.

A Bench headed by Justice BN Agrawal said the matters will be heard by the same Bench which had granted bail to Dutt and five others.

Tiger Memon, a prime accused in the case, has been declared a proclaimed offender.

Tiger's brothers Yusuf and Essa and his sister-in-law Rubeena Memon have sought interim bail on the ground that they have not yet received the copy of the judgement relating to their conviction pronounced on September 12, 2006.

"Let it be before the same Bench. Let it come on the date fixed on September 7," the Bench also comprising Justice PP Naolekar said when senior advocates Abhishekh Singhvi and Altaf Ahmed mentioned the matter before it.

The three Memons and another woman Mubina Bhiwandiwala, sentenced to five years rigorous imprisonment sought similar relief as was granted to actor Sanjay Dutt.

A Bench headed by Chief Justice KG Balakrishnan on August 20 had granted relief to Dutt and five others.

The court had said those who were on bail at the time of sentencing will remain on bail and those who were in custody will remain in custody.

While Memons were sentenced on July 27, Bhiwandiwala was awarded prison term on June 14.

Their counsel submitted like Dutt they were also on bail till the order on sentence was pronounced and they are entitled for same order.

When the Bench said it will not pass any order, the senior advocates sought issuance of notice for early hearing.

However, it said it will not go into the matter.

Yakub, another brother of Tiger, has been awarded death sentence for his role in the Mumbai blast.

Yakub, Yusuf, Essa and Rubina were all found guilty of participating in the conspiracy behind the blasts.

Essa was charged with conspiracy and allowing his flat in Al-Husseni building in Mahim to be used for conspiracy meetings and storing arms, ammunition and explosives.

Yusuf and Rubina were slapped with similar charges.

Bhiwandiwala had allowed her residence to be used for meetings in which the plan to carry out the serial blasts on March 12, 1993 was finalised.
