Court orders police to arrest Dawood's sister

A sessions court directed the police to arrest the gangster's sister by May 16 in a case where she is accused of criminal intimidation and cheating.

MUMBAI: Raising questions whether the police was "seriously investigating" the case involving a sister of gangster Dawood Ibrahim, a sessions court on Monday directed the police to arrest her by May 16 following charges of criminal intimidation and cheating.

The court was hearing the anticipatory bail application of a co-accused Chandresh Shah, when it was informed by a crime branch official that a warrant had not yet been issued for the arrest of Haseena Parkar.

Upon hearing this, Additional Sessions Judge A V Nirgude told the prosecution, "If you arrest Parkar, I will not allow Shah's bail".

He said, "The main accused is clearly Parkar and her relation with well known gangster Dawood Ibrahim makes this case of a very serious nature."

"I was wondering whether the crime branch is investigating the case seriously," Judge Nirgude remarked.

Stating that the police had made no fruitful progress in the investigation, he further added that Shah's application could wait till May 16, if by then there was some progress.

The court also said that a case of extortion cannot be made out against any of the accused and maintained it must be treated as a case of cheating and criminal intimidation only.

Later when the court queried why Haseena had not been arrested yet, additional public prosecutor R V Kini made certain remarks which he immediately sought to withdraw with the court's permission.

The judge then ruled that the remarks would not go on record of the court.

Chandresh Shah has been implicated in a case of cheating, extortion and forgery registered against Haseena and seven others by a real estate agent after a property redevelopment scheme went sour.

Complainant Vinod Avlani had alleged that co-accused Shukla brothers were paid Rs one crore and failed to return Rs30 lakh out of the amount after the deal went sour.

Haseena had allegedly mediated in the deal and also threatened Avlani.

The Shukla brothers, who were arrested last month, had applied for bail.

The application was heard by Additional Sessions Judge Shrihari Davare, who rejected the same on Monday as the investigations have not been completed and the other accused persons are still to be arrested.
