SC transfers MF Husain cases to Delhi

Painter MF Husain, facing criminal cases in several states for alleged obscenity, on Monday received relief with the Supreme Court conceding his plea that all the cases slapped against him be transferred to Delhi.

NEW DELHI: Painter MF Husain, facing criminal cases in several states for alleged obscenity, on Monday received relief with the Supreme Court conceding his plea that all the cases slapped against him be transferred to Delhi.
 
Agreeing to the pleas of one of the complainants, a Bench comprising Justices KG Balakrishnan and DK Jain, however, directed Husain to bear all the expenditure to be incurred by the complainants and their witnesses for their deposition in the capital.
 
Cases of obscenity for alleged obscene paintings with suggestive captions on Hindu gods and goddess are pending against Husain in courts in Rajkot, Indore, Bhopal and Phandharpur (Mahrashtra).
 
The Bench passed the direction on senior counsel Mukul Rohtagi's plea that the internationally renowned artist be given relief in view of his advancing age of 92 years.
 
He claimed that the charges were baseless as the alleged offences were the handiwork of the gallery owners for which Husain cannot be faulted.
 
However, Baban Kumar Sharma advocate appearing for one of the complainants opposed the transfer on the ground that it would put the complaints of the different states to difficulties as they would now have to incur huge expense for pursuing the cases in Delhi.
 
"If the reason was only Husain's age, then the cases could be transferred to Mumbai where the artist resides," he said.
