The Nagpur Bench of the Mumbai High Court is treating a farmer’s complaint as a PIL

NAGPUR: Treating a poor farmer’s complaint against Congress MLA Dilip Sananda as a Public Interest Litigation (PIL), the Nagpur bench of the Mumbai High Court dispatched notices to members of Sananda family, Buldana Police and Maharashtra Government to file replies by July 28.

The indebted farmer made a desperate plea to the high court against the family of the Khamgaon (Buldana) Congress legislator, who along with his family members, is facing close to 40 cases under the Bombay Money Lenders Act in that district, informed sources told DNA. He wrote to the court apparently.

Viewing the letter seriously, the high court bench comprising Justice RMS Khandeparkar and SR Dongaonkar asked the Buldana police to file a compliance report on this individual farmer’s case, and on a list of other complaints against the family pertaining to their coercive methods. The development is significant in view of the rising suicides by farmers in the region and the inaction of the police against the big loan sharks.

Incidentally, members of the Sananda family, who enjoy considerable clout in the present government, have already knocked on the doors of the high court challenging the constitutional validity of section 13-B of the said Act. They have urged the court to strike down this particular section.

The said section deals with disbursal of power of inspecting officers to deal with the property found to be in possession of a money lender which was pledged to him by a debtor as security for the loan advanced in course of business of money lending without a valid license.
