MUMBAI: A special court on Friday adjourned till June 5 the perjury trial hearing against Zaheera and two family members, for giving false evidence during retrial of the Best bakery case after the filing of a revision application before the Bombay High Court challenging a special court verdict.

Special Court Judge Abhay Thipsay dismissed an application filed by advocate Umesh Deshpande two days back, seeking a stay of the perjury trial proceedings in view of their filing a revision application in the high court.

Adjourning the trial proceeding, the judge directed the advocate to bring the stay order from the high court till then, otherwise he will continue to hear the perjury trial and no more adjournment will be entertained.

Thipsay had issued the perjury notice under Section 344 of the CrPC for giving false evidence during the re-trial of the case against Zaheera, her mother Sehrunissa, brother Nassibullah and sister Saherabanu.

The special court on May 16 convicted Sehrunissa to three months rigorous imprisonment and pay a fine of Rs 500 under perjury charges.

The court granted one month to her to challenge the order in the higher court, as sought by her, and she was released on a personal bond.

Deshpande told reporters the court had made several adverse remarks against his clients, who were the prosecution witness in the case, therefore, his clients had challenged all adverse remarks made against them in the high court.

The special court, which conducted the retrial into the Best Bakery case of Vadodara, had convicted nine accused to life imprisonment while acquitting eight others.

The 17 had been rearrested after acquittal by a fast track court in Vadodara due to lack of evidence while four are absconding.

Zaheera is serving a year's imprisonment at the Byculla jail for contempt of court, awarded by the Supreme Court on March 8.
