‘No record to show Adarsh stands on defence land’

There is no record to show that the land on which the Adarsh society building stands is owned by the ministry of defence, defence estates officer (DEO) Geeta Kashyap on Monday told the Adarsh inquiry commission.

Even major general SS Jog, who was former staff administrative officer to accused major general AR Kumar, general officer commanding, has referred to two letters in his affidavit stating that the land does not belong to the defence.

The first was written by the DEO on March 30, 2000, to the headquarters, Maharashtra and Gujarat area, intimating that “it was verified from records that the land in question which forms part of Block VI of Colaba division belongs to government of Maharashta and fell outside the defence boundary.” The station cell, Mumbai sub area, wrote on March 31, 2000, that “as per their record, army land does not fall in Block VI of Colaba division.”

Kashyap submitted two files to the commission relating to Adarsh, which she said were found “lying unattended in cupboard with old documents” after a search in mid-November 2010. She said correspondence in the files relates to whether the land belongs to the collector and she did not find any documents or original award from the files to show that the land is owned by the defence ministry.

Kashyap said that she maintains all record of defence land, which is called the military land register. However, she said that the barrack housing the Station Health Organisation in Block VI is not entered in the register.

Jog, who works as provost marshal, HQ New Delhi, said he had no personal knowledge regarding ownership of the land. He said that based on the two letters, HQ, on April 5, 2000, replied to the collector intimating that the “land fell outside the defence boundary and necessary action may be taken as deemed fit for the welfare of service personnel, ex-servicemen and their widows.”
The commission has extended the date for submission of affidavits by former state chief ministers to May 26.
