No playing songs without licence: Bombay high court

The JW Marriot said that they had already obtained the licence and will be paying the licence fee.

The vacation bench of the Bombay high court on Wednesday passed several directions to various hotels in Mumbai, Pune and Goa regarding the playing of music under copyright for the New Year parties.

Last week, a single judge of the vacation court had granted relief for hotels holding Christmas and New Year parties by refusing to restrain them from playing music without paying royalties to Phonographic Performances Limited (PPL).

On Wednesday, the PPL filed an appeal before a division bench, following which, directions were passed and undertakings were filed by some hotels.

The PPL had dragged 17 hotels, including the JW Marriot, Taj
Lands End, Supreme Heritage, Gallops, Hard Rock Cafe, Imperial Banquets and Leela Kempenski as respondents in its petition.
Last week, justice KK Tated had refused to grant interim relief to PPL.

The division bench of justice SA Bobde and justice Anoop Mohta accepted the undertakings submitted by most of the hotels and held that, in no case, shall the hotels play any songs owned by PPL without obtaining licence first.

The JW Marriot said that they had already obtained the licence and will be paying the licence fee.

While some hotels have informed that they will not play any songs owned by the PPL, some others have undertaken to obtain a licence in case they intend to play music owned by PPL.

The high court has directed those hotels to intimate the list to the PPL by noon on December 31.

The PPL had contended that hotels make huge profits by playing their music during Christmas and New Year parties. Playing music of their clients without paying the royalties amounts to infringement of copyright, they said.

The hotels had earlier stated that they had paid for the license meant for the whole year, including December 31.
