The Bombay high court on Monday directed the Navi Mumbai police commissioner to appoint an officer not below the rank of assistant commissioner to probe into allegations made by an alleged Indian Mujahideen operatives, Mohammed Atik Mohammed Iqbal and three others, about them being not produced in court as the police officials escorting them wanted to watch a cricket match.
The accused Iqbal, Majid Akhtar Sheikh, Dastagir Mujawarh and Yaseer Sayyed have written a letter to the high court stating that they were not produced before the special Maharashtra Control of Organised Crime Act (MCOCA) court on April 30.Division bench of justices BH Marlapalle and UD Salvi observed, “These are serious allegations, the police have to probe into it and submit a report to the prosecutor within four weeks. The prosecutor will, in turn, inform the court accordingly.”
As per the letter written by the accused, who are allegedly accused of being conspirators in the serial bomb blasts across the country
allegedly done by IM operatives in 2008, they were to
be brought to the court and the Taloja prison officials had called for escort party accordingly.
The police officials brought them to the court in Kala Ghoda area at around 11.15ambut till then the case had been adjourned.
According to the accused, one ASI Patil and one police constable, Rajendra Janwalkar, told the accused that the case had been adjourned and they were to be taken back.
The accused also found out that there was a cricket match to be held at around 4pm that day, which the policemen did not want to miss, thus they escorted them back to the prison, even when their advocate had told the police to produce them at 2.30pm before the court.
The letter also said that the policemen abused them when they brought them back to the prison, and that their important applications for medical treatment and leave to apply for educational course was not put before the court.
The letter prayed that “We get opportunity in 15 days to visit the court and therefore it is important for us to meet our lawyer to know the details of our case. This was denied to us, thus an inquiry against the concerned officials should be held.”
