Prosecutor RV Kini and advocate Harshad Ponda on Monday ended their arguments for the bail application by Kannada actor Maria Susairaj in the Neeraj Grover murder case.

After three days of hearing, sessions judge ST Mahajan will now pass order on the application on Tuesday.

Susairaj and her boyfriend Emile Jerome had allegedly killed Neeraj Grover at the actor’s flat in Malad on May 9. They allegedly dismembered the body and burnt it at Manor.

Kini argued that there was prima facie evidence that Susairaj was the main accused/conspirator and that she participated in the murder equally with her boyfriend, a naval officer. “The charge sheet is replete with evidence,” argued Kini while enumerating that besides the statements of witnesses, there is objective scientific evidence in the form of a DNA report which shows that Susairaj had injured herself with a sharp weapon during the murder. “Her blood is found in the same room where Grover’s blood was also found.” said Kini.

The prosecutor argued that Susairaj had a motive. She thought that Grover had cheated her by not getting her promised roles in TV serials.

He also argued that Susairaj was concerned with saving her own skin as that of Jerome. “Susairaj and Jerome kept calling their friend from whom they had borrowed the car in which they carried Grover’s body to Manor for disposal,” said Kini.

Susairaj’s advocate Ponda pointed out that there were no eyewitnesses. He said that there is no mention of any sound emanating on the fateful night from Susairaj’s flat where the murder allegedly took place. “A person is bound to cry out when he is stabbed and there would certainly be some scuffle,” said Ponda. “Yet, no one seems to have heard anything.”

Ponda closed his case for bail saying that Susairaj’s only offence is that she kept quiet and assisted Jerome in getting rid of the evidence. “She was frightened and supported the man she loved. The evidence is not enough to show she participated in the murder. She can be charged with disposing of the evidence and no other crime,” argued Ponda.
