Maharashtra government proposes amends in MRTP Act to crack whip on developers

Decision taken in order to ensure early handover of developed amenities like playgrounds

Maharashtra government has decided to amend the Maharashtra Region Town Planning (MRTP) Act in order to ensure the early handover of the developed amenities, facilities and services by developers. The amenities and services include recreation ground, playground, hospitals, school, etc.

Ravindra Waikar, minister for state housing on Tuesday told DNA that currently most developers undertake the SRA redevelopment projects but they frequently fail to hand over the developed reserved places on time.

"In a project, most of the developers sell their component and handover the rehabilitation portions to the tenants. However, there is a perpetual delay while handing over hospitals, schools and garden. The residents suffer the most(sic)," said Waikar.

He said that as per current MRTP Act, the developer can handover developed places when they complete the 75% portion of the project. "There are developers who are taking the projects and sitting over it for last several years while the consumers keep waiting. We have decided to amend the MRTP Act to ensure the timely development and handing over of the amenities. Now as per this proposed provisions, once the 50% of the portion of the undertaken project is developed amenities need to be handed over," Waikar added.

The action was prompted following the delay caused by city-based Omkar Builder in handing over amenities. "Omkar had made the agreement of development and handing over the recreation and playground, besides developed TB hospital, school and planting 80 trees in this same premises. However, not a single agreement has been implemented by this said developer so far. Interestingly, this project has been going for last 18 years. More than 2000 families have been already shifted in the new towers at Parel," said Kiran Pavaskar, NCP MLC in the Upper House. He demanded actions against Omkar like developers in Mumbai.
