Despite a 'no detention policy' in the same class under the RTE act, Lilavatibai Podar High School, (ICSE) in Santa Cruz has kept back some of its primary class students, claims Forum for Fairness in Education. One of the parents has also approached the education department with a complaint against school.

The no-detention policy was implemented as part of the Continuous and Comprehensive Evaluation (CCE) under the RTE Act to ensure holistic development of students.

Forum for Fairness in Education received complaints from two parents who alleged that despite the RTE rule, their wards in the primary section have been detained in the same class. One is a class III student, and the other studies in class IV.

When the class IV student's father tried to meet Norina Fernandes, the principal of the school, she remained unavailable.

On the condition on anonymity, the parent said that he was never informed about his son's performance throughout the year. "When he was in class 1, we were asked to get him tested for any learning disability, but we were not told anything this year," the class IV boy's father said.

He also said that it was rude of the school authorities to have no time to meet parents. "If we are spending more than a lakh on our child's education in the school, it is the school's responsibility to make sure he is performing well," the father fumed.

Jayant Jain, president of Forum for Fairness in Education said: "Failing a child till standard VIII is against the provision of the RTE Act. This means that no child can be held back in the same class or expelled from the school till the completion of his/her primary education."

When contacted, Fernandes said: "I am ?meeting the parents tomorrow, so I will not comment on that till then."

BD Phadtare, deputy director of school education, said: "If I get any such complaint, I will immediately ask my officials to take action against that school."
