HC quashes charges against reckless driver

Bombay High Court had set aside a criminal case against a 37 year-old businessman, from Malad as he had not only rushed the injured to the hospital but also paid his medical bills and taken good post-accident care.

A division bench of Justice VM Kanade and Justice Nutan Sardessai set aside the criminal case registered under various sections of the Indian Penal Code against, Jason Nath, who had knocked down, Anandi Manikhot, 47, in 2011.

As per the police the injured was walking on the road in Malad area, when all of a sudden the accused gave a dash to him from behind. Manikhot fell unconscious after which Nath rushed him to a nearby Evershine hospital, in his car and paid the medical bills amounting to Rs 1,20,000. He would also regularly visit the hospital to check on the progress made by Manikhot, which continued till he was discharged from the hospital a few weeks later.

The plea filed by Nath claimed, police has already filed a chargesheet in Andheri Metropolitan court. However, Manikhot and Nath had come to an amicable settlement and he did not have any objection to the case being quashed and set aside.
