EOW case against builder for cheating actress Saira Banu

The Mumbai Police's Economic Offences Wing has registered a case against a Bandra-based builder, Sameer Bhojwani, after actor Dilip Kumar's wife Saira Banu filed a complaint against the builder for allegedly cheating her and forging the property documents of a plot leased by Kumar.

In December 2017, Banu had claimed that the developer was harassing and threatening her and Kumar, over the plot in Pali Hill, Bandra (west).

After an inquiry, the police, after obtaining a report from the registration office, have come to the conclusion that the builder, by conspiring with the officers from the Registrar of Assurances, illegally and fraudulently registered the deed of confirmation, where Bhojwani is the vendor and also a buyer of the property belonging to Kumar.

According to the police, Kumar had leased the property by paying Rs 1,40,000 in 1953 to the lessee identified as, Khatau family. He moved out of the place in 2017 with the intention to redevelop the two-storey bungalow. He roped in Prajita Developers for the purpose. However, since the plan did not take off, Kumar backed out.

Bhojwani has claimed in the allegedly forged documents that his late father paid Rs 25,000 in 1980 to Khatau to lease the property. However, he did not register the document in favour of his father. And as such, he executed the deed of confirmation only in 2002.

"Bhojwani has been absconding. We had conducted raids at Bhojwani's office and residence from where we found a few weapons such as daggers and swords. We have seized them," said a police officer.

The matter eventually went to court, and last year, the Supreme Court directed Kumar to pay Rs 20 crore to the builder and retake the possession of the property.

However, the developer had then objected to Kumar's bid to redevelop the area, claiming that the ownership of the property had been passed on to his father and leased to Kumar with the condition that the structure won't be altered.
