Rajasthan: Stamp duty must for documents

The dept has warned that disposal of documents without due stamp duty is criminal offence

Documents with unpaid stamp duty will not be acceptable and will be impounded if produced at any of the public office. The Rajasthan Registration and Stamps department has written to all the state and central government departments concerned to screen for stamp duty violations and report the case to collector (Stamps) for further action.

The recent circular insists on implementation of the provisions already contained in the registration and stamps act.  “It is due to non-compliance of these provisions that the comptroller and auditor general (CAG) has taken severe objections in several of their audit reports,” says a senior officer at the stamps department. 

According to the department officials, in many instances the CAG team while auditing public offices reported stamp duty evasion. Such cases later had to be investigated by the Registration and Stamp department. 

The recent circular insists that disposal of a document without payment of due stamp duty is an offence punishable with penalty of Rs 5000. The stamps act also provisions for penalty and imprisonment up to two years of imprisonment. 

The state government in a notification of  year 1997 had included in list of ‘public office’ all state and central government offices, civic and local bodies, cooperative institutes, civic and criminal courts and several other government and autonomous agencies. 

The state registration and stamp act that came into effect in 1998 makes in-charge of the public offices to ensure that documents being disposed by them do not have stamp dues pending upon.

The evasion of stamp duty taxes is also caused due to non-registration of documents that are required to register with the department.  The department has thus provided a list of applicable stamp duty and registration charges for various purpose to related public offices.
