Court order deals blow to Joshi-led RCA

Ombudsman, ethics officer reinstated: Joint secretary Nahar’s letter set aside as unlawful, may face contempt of court

In a major setback to C P Joshi-led Rajasthan Cricket Association (RCA), the Jaipur bench of Rajasthan High Court has not only ordered the reinstatement of RCA Ombudsman former justice Gyansudha Mishra and ethics officer Pana Chand Jain but also said the current dispensation has committed the contempt of court.

On the basis of an application filed by RCA treasurer Pinkesh Jain, who belongs to the Lalit Modi group, the court set aside the letter issued to Ombudsman Gyansudha Mishra and ethics officer Pana Chand Jain by joint secretary Mahendra Nahar who is officiating as the secretary, calling it unlawful.

The court said both the officers were working on the orders of the Supreme Court and such an act of Nahar comes under the contempt of the court.

The court ordered both the officers to resume their posts and also ordered that contempt petition may be filed by parties against RCA officers who issued such letter.

The decision is being seen as a shot in the arm for the Lalit Modi group as  now all the RCA disputes will be settled by ombudsman.

The single bench of justice JK Ranka was hearing the petition filed by Rampal Sharma.

During the hearing court has also ordered JDA to file an affidavit about sports grounds not being used for non-sports activities.

Along with this, the bench has also ordered the law department to complete the process it had adopted to implement the Lodha committee recommendations on other sports also .

During the hearing, the government informed the court about the steps it is taking to implement the Lodha committee recommendations in the state .

It informed that Justice NK Jain committee had been formed for  amendments to be made in the Sports Act.
