We need to assess impact of law on society: Madhav Menon

Menon, a former director of National Judicial Academy, said that there is a need for research and surveys to find out if statutes that have been enacted and enforced have brought about the change which the legislators had intended.

There is a need to assess the impact of law on society so that law making bodies can frame statutes that are more action oriented and do not just provide remedial process, said professor Madhav Menon, director, National Law School, Bangalore, at a national seminar organised by Nirma University.

Menon, a former director of National Judicial Academy, said that there is a need for research and surveys to find out if statutes that have been enacted and enforced have brought about the change which the legislators had intended.

Menon raised the issue while addressing the audiences at the two-day national seminar organised by the Nirma University on the subject of Law Impact Assessment. The seminar was inaugurated by Menon and Justice CK Thakkar, former judge of the Supreme Court, on Friday. "Scholars and sociologists have done research on all subjects except impact of law on society.

Whenever experts of the legal fraternity tried to do the same, they ended up analysing the statutes and court orders," the professor said.

The senior law professor said that researchers should conduct survey on the practical impact and implementation of the statutes.

"This kind of research and surveys will help law makers in knowing the ground reality and bring in reforms," Menon added.
Taking the issue to the next level, justice Thakkar, said that studies on the impact assessment of law are needed since they work as a social audit of the legal and judicial system. "The makers and enforcers of the statues are human and they can commit mistakes. We can point this out through such kind of social audit," Thakkar opined. The seminar will focus on enabling the making of laws that are action oriented and conducive to meet modern day requirements.
