Two groups fight over shrine construction in Ahmedabad

Two factions of the same community have claimed the plot on which the mosque is to come up.

The construction of a mosque in Danilimda has pitted two groups from the Muslim community in the city against each other. The mosque was to come up at common plot situated between two residential societies in the area.

The matter has now reached the city civil court after members of
both the societies failed to settle the issue through a dialogue. Earlier, when a group from one of the societies sought a stay on the construction of the mosque, a judge of the city civil court ordered an inquiry and appointed a court commissioner (representative of the court) to look into the matter.

The court commissioner recently visited the disputed site and submitted a report to the city civil court.  The court will now hear arguments from both the parties to decide whether a stay order should be given or not.

A common plot between Kirtida society and Kirtikunj society is at the centre of the dispute.  The tussle began when some people from the Kirtikunj society began constructing a mosque at the common plot. But the move was challenged in the court by one Arif Shaikh of Kirtida society and two members of the Kirtikunj society. 

The have named one Ibrahim Wadiawala and three others of Kirtikunj society as respondents.  Shaikh has alleged in the suit that the respondents intended to forcefully take possession of the land and construct a madrassa and that they did not follow the correct legal procedures. They have also claimed that earlier a suit was filed in the city civil court in 1998 and the plot is the property of Kirtida society.

The applicants further alleged that the Kirtikunj society is not a registered residential society. Meanwhile, the residents of Kirtikunj society filed a reply in the court stating that the open plot is not a common plot between the two societies that are situated far from each other. The residents have stated that the plot belongs to Kirtikunj society.

They said that the mosque was being built so that residents from the nearby area could pray there.
