TRAI report can’t be part of court records: CBI

The CBI on Thursday indirectly questioned the telecom body TRAI’s way of functioning and its methodology in preparing the report on the 2G spectrum scam.

Calling the report of the Telecom Regulatory Authority of India unsolicited, CBI special public prosecutor UU Lalit told CBI special judge OP Saini, “The CBI can’t rely on a document about which we don’t know how it was prepared, what the methodology was used to formulate this report.”

“We have traveled far beyond in this case and at this stage we can’t include this document as there was no specific direction from the court for including this TRAI report in the record. Let the court pass a specific direction in this regard and then we have no problem in placing the report on record,” he told the court.

Lalit’s submission came on a TRAI’s covering letter on the report by RK Arnold of the telecom body, which said: “TRAI repeatedly held the view that telecom services and spectrum should not be treated as a source of revenue for the government. It is against this background that TRAI did not recommend any increase in the entry fee for new players, by way of indexation or otherwise.”

The court which was scheduled to pass order on framing of charges against all the 17 accused, postponed it till Friday.
Countering Lalit’s submission, senior advocate Rajiv Nayyar appearing for Reliance ADAG official Gautam Doshi said, “The TRAI report placed on record is a document which was placed under section 173 (A) and at this stage of framing of charges the same can’t be withdrawn like this.”

Former telecom minister A Raja claimed that if the TRAI report is placed on record, it will change the direction of the trial.
