There’s hope for 560 denied non-agriculture land

Collector to reopen the files that failed to get ‘non-agricultural’ status in 2011.

Ahmedabad district collector has decided to reopen around 560 files that were not granted permission for conversion of agricultural to non-agriculture (NA) land. These applications were submitted in 2011. The collector will take the decision in a couple of months. Meanwhile, at an open house on Wednesday, the collector disposed a total of 123 applications
under consideration.

Many applicants who had lost hope of getting NA status for their agricultural land are likely to get yet another chance. “Around 560 applications were filed in 2011, but they were rejected for one or another reason. However, we will now guide the applicant in providing missing documents as well as explain the reason for his file being rejected,” said Vijay Nehra, district collector of Ahmedabad.

The district collector has divided these files into three categories. The first category will cover applications that were denied NA permission on substantive ground. These grounds include demand made for setting up residential project on land falling in agriculture zone; land falling under Urban Land Ceiling Act; or non-payment of premium for converting land from new tenure to old tenure.  

The second category will include applications where the applicant needs to provide missing documents such as zoning certificates and others. The third category will include applications where the demand for converting land into non-agricultural was rejected as any of the government department did not give no-objection certificate.

Nehra admitted that hardly anything could be done in the first category but the applicant will be informed why his demand cannot be granted. In the second category, the applicant will be guided to provide various documents and the file will be reconsidered. After this, there will be more chances of a decision in his favour, said Nehra. In the third category various departments will be asked to provide their opinion on the demand, on the basis of which the final decision will be taken,
he said.

The collector also claimed that not a single application that was filed before March 31, 2012, was pending for NA certificate. He also said that earlier, in case of any document missing, the file was not inwarded through civic centre. Therefore, it was difficult to track the file, but the collectorate has re-engineered the system and mandated to in-ward the file in the civic centre only to keep track on it, said Nehra.
