Supreme Court seeks data on backlog of cases from courts

Gujarat high court and state’s lower courts have to send data for the period between January 2001 and December 2011

The Supreme Court has sought year-wise statistics from all high courts and the different courts under their jurisdiction, on cases pending with them during the period January 2001 to December 2011. The apex court has also asked for information on the number of cases disposed of by the different courts (including the high courts) each year.

Official sources in the Gujarat high court stated that the Supreme Court had asked the Gujarat high court (and other high courts as well) to send a report with the year-wise statistics on pending cases and cases disposed of each year. The sources said the Apex court had asked for the data in an effort to find a solution to the growing backlog of cases in different courts of the country.

The lower courts have been asked to give, for each year, the break-up of the number of cases pending at the beginning of the respective year, the number of the cases filed during the year, the number disposed of during the year and the number pending at the end of the year.

The sources said the Gujarat high court has already informed the lower courts about the Supreme Court's request and had asked them to provide the data in the format sought by the apex court.
Official sources at the metropolitan magistrate court, Ahmedabad, confirmed that the high court had sought data on pending cases on the direction of the Apex court and had asked the magistrate court to submit the information by April 1.

The sources further said that the apex court had sought the statistics in tabular format. Moreover, the information sought had to be submitted separately for the cases. The cases had been divided broadly into different categories according to acts (such as prohibition act) under which they were registered, the sources added.

The sources further stated that besides giving information about the cases according to acts, the lower courts had to give the pendency rate and disposal rate of the cases in each category. This would give the broad picture and help identify the root cause of the growing backlog of cases.

Officials of the Gujarat high court (administration wing) confirmed on the condition of anonymity that they had asked for the information from the lower courts. As soon as the information sought was received from them, the high court would send a report to the Supreme Court, the officials said.
