A bench of justices Markandey Katju and TS Thakur, while allowing the US couple Craig Allen Coates and his wife Cynthia Ann Coates to adopt the child asked the Centre to constitute a committee to decide in future on such inter-country adoptions, particularly in cases of children with such disabilities.
The apex court passed the order, while quashing the concurrent judgments of the District judge and the Delhi high court which had earlier ruled that the couple cannot adopt the child since it appeared to be an attempt to abuse the child as a domestic servant after taking him to the US.
The Delhi high court had on August 31 last year rejected the plea of a cerebral palsy-afflicted Craig Allen Coates, and his wife, residents of Winnebago, USA, to adopt a minor Indian after holding that the couple, already having two sons and a daughters, intended to exploit him as a domestic help.
Aggrieved by the two lower court rulings, the couple appealed in the apex court.
Subsequently, at the behest of the Solicitor General Gopal Subramanium, a four-member committee of psychiatric experts headed by Professor Rajat Ray, head of the department of psychiatry, AIIMS interviewed Cynthia Coates and the child and gave a finding that the minor could get the best emotional support from the couple.
Accepting the report, the bench allowed the couple to take the child along with them to the US.
