SIT wants Maya Kodnani bail cancelled

The Special Investigation Team (SIT) has decided to move applications before the Gujarat high court seeking cancellation of the bail given to the accused in the Naroda Patiya and Narodagam and Gulberg society massacre cases. Former minister and BJP MLA Maya Kodnani, former VHP general secretary Jaideep Patel and others were earlier granted bail in the case by local courts.

Moreover, in a bid to ensure free and fair trial in the Naroda Patiya, Narodagam and Gulberg society massacre cases, the SIT has already made a recommendation to the state legal department to cancel the bail of the accused including Kodnani and Patel in the three riot cases. The SIT is now awaiting consent of the state government.

Sources close to the development said, "We have taken this step after taking a look at the role played by the accused and the possibility of their being able to influence the riot case."

Kodnani, who is accused in both the Naroda Patiya and Narodagam cases, is facing charges of provoking a mob which killed 108 people from the minority community in both the incidents on the morning of February 28, 2002. Patel is facing charges for instigating a mob in the Narodagam case, where eight people were killed.

The duo had earlier surrendered before the SIT and was later arrested after the Gujarat high court rejected their anticipatory bail petition.

Maya and Jaideep were then released on bail by a city sessions court on May 19 after their remand period came to an end. Both the leaders had spent about two weeks each in jail and police custody.

The SIT has finalised the names of almost 20 accused in the Naroda Patiya case including Kodnani.

Kodnani and Patel's names figure in the Narodagam case while 8 other names have been mentioned in the Gulberg society massacre case.

"The names have been sent to the legal department after taking into consideration the opinion of special prosecutors appointed by the SIT," another source said.

The SIT along with the special prosecutors is still in the process of scrutinising documents of another accused.  "Court orders and related documents of many of the accused are yet to arrive from the court. After going through their role as well as their 'possibility' and 'capacity' to influence the case and witnesses, we will also be recommending their name for bail cancellation," the source said.

At present, most of the accused in the three cases are out on bail. The SIT will move an application before the Gujarat high court once it gets the nod from the state government.
