Punjab to shelve Bhullar resolution

Chief minister Parkash Singh Badal indicated that “a resolution for clemency for Bhullar would be introduced in the coming session of the Punjab Vidhan Sabha only if there was a possibility of getting it passed”.

While former deputy speaker Bir Devinder Singh has said that the rules of the Punjab assembly did not allow a resolution in favour of KLF militant Davinder Pal Singh Bhullar to be tabled in the House as the case was pending in a court, chief minister Parkash Singh Badal indicated that “a resolution for clemency for Bhullar would be introduced in the coming session of the Punjab Vidhan Sabha only if there was a possibility of getting it passed”.

As the state BJP and the Congress have already sounded their opposition to it, the controversial resolution might never be tabled in the House as the Akalis do not enjoy majority on their own.
“We (SAD) wanted to bring a resolution to convert Bhullar’s death sentence to life imprisonment for his benefit, but the Congress and other political parties are opposed,” he said here on Friday. 

Earlier, the former deputy speaker said, “as per the existing Rules of Procedure and Conduct of Business in the Punjab Vidhan Sabha, rule 93 sub rule (2) clause (IV) clearly debars a member of the House from referring to any such matter on which a judicial decision is pending in a court.” He said an MLA could not refer to a matter on which a judicial decision was pending.

“This clearly implies that the issue relating to commuting the death sentence to Bhullar cannot be discussed on the floor of the House as the case is being heard by the Supreme Court.”
“If at all the Punjab government wishes to discuss the matter in a form of resolution, then the government will have to request the speaker to suspend Rule 93 sub rule (2) clause (iv),” he added.
