NRI child row: Teacher moves SC again on behalf of child

A review petition was filed in the Supreme Court today challenging its earlier decision directing a runaway NRI mother to return to the US along with her minor son Aditya and husband within 15 days.

The petition claimed Aditya was unwilling to go back to his father Ravichandran and instead wanted a "dungeon" at his mother Vijaysree Voora's house in Chennai so that he can hide himself and avoid going back to his father in the US.

Such was the mental state of the child, said the petition filed by D Bharati claiming to be the montessori teacher of Aditya in Chennai where the boy was studying in a school.

According to counsel Lily Thomas, the apex court while passing the November 17, 2009, direction to the NRI couple did not take into account the views of Aditya. Hence, she urged the apex court to review its judgement.

A  bench of justices Tarun Chatterji, RM Lodha and BS Chauhan had earlier ruled that if Vijaysree fails to comply with the direction to return to the US, the husband would be entitled to the custody of the child after the 15-day period and can take him to the US on his own.

While giving the direction, the court said the husband would bear all expenses for their return and stay in the US till they move the appropriate court in New York for custody of the child.
