The Nano project, marked by impediments since inception, has managed to get entangled in yet another legal wrangle - this time a royal tangle.  The prince of the erstwhile state of Sanand, Jayshivsinh Vaghela, has challenged the land acquisition process conducted by the state government for the Nano project of the Tata Motors in the Gujarat high court.

The case has come up for hearing before justice DA Mehta of the Gujarat high court.
However, Mehta has instructed the registry to put the case before another judge, who has the jurisdiction to hear land acquisition cases. The case is expected to come for hearing on Monday.

The Gujarat high court earlier dismissed two petitions filed against the Nano project near Sanand. While one was a public interest litigation moved by president of one Rashtriya Kisan Sangh on grounds of vague allegations, the other was a petition moved by the farmers of Khoda villages, but which was dismissed by the high court, which observed that the government has followed proper norms prior to acquiring the land for the Nano project. However, appeal against the high court order is pending before the Supreme Court.

Vaghela has moved a petition in the Gujarat high court as his land is being acquired by the state government for the Nano project. Sharvil Majmudar, counsel for Vaghela, submitted that his land situated in the Bol and Kalana villages were given on lease by his ancestors to the Gujarat Cattle Preservation Association at an annual rental of Rs600. The lease period got over in 2003, after which he made several representations to the several government authorities to get back the land.

The counsel further submitted that, the state government had acquired land to establish Nano project of the Tata motors. When Vaghela moved the court he received an application under the RIT which read that his land was not acquired for the Nano project.
However, the government still handed it over for the Nano project. Majumdar therefore, demanded that Vaghela should either be given the land back or be given adequate compensation for it.
